Administrative Receivership
- An Administrative Receiver is appointed by the holder of
a fixed and floating charge over the company's assets.
- An appointment will be made when the directors request it or when the
charge holder considers that there has been a breach in the terms of the
debenture deed.
- When the administrative receiver is appointed he takes control of the
company's affairs and he is able to dispose of the assets to repay the charge
holder's debts without consulting other creditors.
- Businesses are often sold as a going concern preserving core businesses within a company.
